Please read these Terms of Use carefully. By accessing or using any OpenTopography services, you agree to these Terms and our Privacy Policy.

The OpenTopography website and portal, and services (collectively, the “Services”) are made available to you by OpenTopography subject to these Terms of Use (the “Terms”) and in accordance with the OpenTopography Privacy Policy  (the “Privacy Policy”).

Account Information

You must register for an account on OpenTopography to use some of our Services.

You must be at least 16 years old to create an account on OpenTopography. Minors under 16 and at least 13 years of age are only permitted to use our Services through an account owned by a parent or legal guardian with their appropriate permission and under their direct supervision. Children under 13 are not permitted to create accounts on OpenTopography. You are responsible for any and all account activity conducted by a minor on your account.

User verification on the Internet is not easy and we do not assume any responsibility for the confirmation of any account holder’s identity. We do not require account holders to provide a form of government identification or other information or undertake additional checks designed to help verify the identities.

You are solely responsible for maintaining the confidentiality of the password associated with your account and for restricting access to your password on all devices being used to access our services. You are responsible for all activities that occur under your account or from your computer and mobile devices. We endeavor to use reasonable security measures to protect against unauthorized access to your account information in OpenTopography. We cannot, however, guarantee absolute security of your account, or the personal information you provide, and we cannot promise that our security measures will prevent theft of your digital information by a third party. You agree to immediately notify OpenTopography of any unauthorized use of your account or password, or any other breach of security, and confirm that you understand all risks of unauthorized access to OpenTopography and any  information including personal information you provide to OpenTopography.

OpenTopography may contain links to third-party websites, services and resources which may be subject to different terms and conditions and privacy practices. OpenTopography is not responsible for the availability, content, products or services available from these third-party services and links to these are not an endorsement.

You may terminate your account anytime by emailing us at info@opentopography.org.

Service Availability

OpenTopography does not guarantee the continuous and uninterrupted availability and accessibility of the data and services provided. We also may restrict the availability of our data and services in cases where integrity or security of our servers are at risk or to perform maintenance to ensure the proper or improved functioning of the OpenTopography platform. OpenTopography may also improve, enhance and modify existing services and occasionally add new services to improve overall user experience.

Data and Content

Data obtained from OpenTopography are free of all copyright restrictions and made fully and freely available for both non-commercial and commercial uses. Certain datasets may have open data licenses (e.g., Creative Common CC BY 4.0) associated with them. Users of the data are responsible for license compliance and should attribute the source of the data as well as OpenTopography for providing access to those data. Specific dataset citation language may be provided on dataset landing pages. Instructions for acknowledging OpenTopography and the data we host can be found on the Citing OpenTopography and Hosted Data page.

OpenTopography makes no guarantee of the quality, reliability, usability, availability, or suitability of any OpenTopography data for any particular purpose. OpenTopography data should not be used for any life-critical functions. Users assume all risks and liabilities, direct or indirect, associated with any use of OpenTopography data

Text and images found on OpenTopography websites can only be reprinted with permission, with attribution, and without the right to manipulate or change its content. All articles, documents, images, and text on the OpenTopography site are copyrighted. Permission to use these materials may be requested by contacting info@opentopography.org.

Software developed by OpenTopography is released via our Github, in most cases under an open source license. See the specific software repository for license information.

Portal Agreement

OpenTopography provides a suite of value-added data access and processing Services. OpenTopography makes no guarantee of the quality, reliability, usability, availability, or suitability of any OpenTopography Services or derivative products for any particular purpose. We regulate appropriate use of these Services via processing quotas and in some cases restrictions on type of user (e.g., US Academic). You may need to register for an account to access these Services. 

API Agreement

OpenTopography provides a set of APIs for accessing and processing data. Creation of an OpenTopography account and generation of an API key may be required for access to certain API services. Individual users must access the APIs with the OpenTopography provided key. Users may not share their keys with other users or make their key accessible publicly. Users are also prohibited from embedding keys within an application or service that enables third party users to bypass the one user, one key requirement.

If you use our API service in your project or research, please acknowledge OpenTopography: "This work is based on API services provided by the OpenTopography Facility with support from the National Science Foundation under NSF Award Numbers 2410799, 2410800 & 2410801." Acknowledgement helps ensure the service remains free and sustainable for the community.

Commercial, for-profit (i.e., intending to make money), integration of OpenTopography API keys into a product or service is not permitted. For these for-profit use cases we offer Enterprise API keys. Enterprise API keys also offer higher daily API rate limits for users who require more frequent access to the service. OpenTopography reserves the right to impose limits on our APIs (e.g. limiting the number of API requests that you may make) to ensure the integrity, security, and proper functioning of our systems. You agree to, and will not attempt to circumvent, such limitations documented with each API.

Users violating the API Agreement may have their Keys revoked and their OpenTopography accounts closed.

Policy Against Abuse

We retain the right to limit privileges or terminate accounts of users who abuse the system intentionally. Abuse can include continued misuse that causes disruption to OpenTopography services.

Users who have their accounts terminated have the right to appeal a decision by contacting us at info@opentopography.org. Please describe the action we took against you and the reason for your appeal. Please note, however, that we have no obligation to consider any appeal, or provide any further explanation or other notice in connection with any appeal.
